Terms of Service

1. Agreement to Terms

By accessing or using RentalWiz Pro (“the Service”), operated by WizPro Software LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

RentalWiz Pro is a cloud-based property management platform that provides tools for landlords and property managers to manage rental properties, leases, tenants, maintenance, billing, and related operations.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information during registration.

4. Subscription and Billing

The Service is offered on a subscription basis. Fees are billed in advance on a monthly basis. You authorize us to charge your payment method for all applicable fees. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are not provided for partial billing periods.

5. Free Trial

We offer a 60-day free trial on paid plans. No credit card is required to start a trial. At the end of the trial period, you must subscribe to continue using the Service. We reserve the right to modify or terminate trial offers at any time.

6. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

• Violate any applicable laws or regulations
• Upload or transmit harmful, fraudulent, or misleading content
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to facilitate housing discrimination in violation of fair housing laws
• Resell or sublicense access to the Service without our written consent

7. Data and Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of all data you upload to the Service. By using the Service, you grant us a limited license to use your data solely to provide the Service.

8. Third-Party Integrations

The Service integrates with third-party services including payment processors, e-signature providers, and smart home device platforms. Your use of those integrations is subject to the respective third-party terms of service. We are not responsible for the availability or accuracy of third-party services.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by WizPro Software LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIZPRO SOFTWARE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may cancel your account at any time. We may retain your data for up to 90 days following termination before deletion.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Disputes shall be resolved through binding arbitration under the American Arbitration Association rules.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes take effect constitutes acceptance of the revised Terms.
